Today I anxiously awaited the ruling from Florida Judge Roger Vinson regarding the constitutionality of Obamacare. As I watched my Twitter feed light up with elated Tweets of joy, I too smiled from ear to ear knowing that yet another Judge had ruled in not only the Tea Party's favor, but that of the Constitution.
"I must reluctantly conclude that Congress exceeded the bounds of its authority in passing the act with the individual mandate. That is not to say, of course, that Congress is without power to address the problems and inequities in our health care system. The health care market is more than one-sixth of the national economy, and without doubt Congress has the power to reform and regulate this market. That has not been disputed in this case. The principal dispute has been about how Congress chose to exercise that power here," Vinson wrote.
"While the individual mandate was clearly 'necessary and essential' to the act as drafted, it is not 'necessary and essential' to health care reform in general," he continued. "Because the individual mandate is unconstitutional and not severable, the entire act must be declared void."
This is what I have been explaining to leftists ever since the health care town halls of 2009. The argument simply goes back to this: a government cannot mandate you to purchase a product in order to be a lawful citizen of this country. It is overstepping the boundaries written in the US Constitution.
"But you want people to die!" is what I have been accused of. No, simply put, the government has gone from merely being an inconvenience in my life to a bully that has barged through my front door and took over.
The beauty in all of this is that not only has Obamacare been deemed unconstitutional, but 38 states have already filed or prefiled the Freedom of Choice in Health Care Act. This act protects the rights of patients to pay directly for medical services, and it prohibits penalties levied on patients for declining participation in a particular health plan. This fight against Obamacare is resulting in a multi-layered strategy to protect Americans from a federal government gone awry.
The irony is that a nation which began by opposing the Tea Tax would create a government that can force you to buy tea. (Thank you @diggrbiii)
